Terms & Conditions
An order for goods placed by you, the buyer shall be subject to these terms & conditions.
All other terms & conditions, expressed or implied by statute or otherwise, are excluded to the fullest extent permitted by law.
Nothing in these terms & conditions shall affect the statutory rights of any consumer.
Ordering & Availability
All orders for goods shall be deemed to be an offer by you, the buyer, to purchase goods pursuant to these terms and conditions.
You, the buyer, shall be responsible for ensuring the accuracy of the details provided to us on the order form (if applicable) and we will not be obliged to accept an order unless all details requested on the order form have been entered correctly. It is your responsibility to check and satisfy yourself that our quotation is sufficient to cover your requirements. If you are a consumer, please note that in the case of geometric/Victorian floors or walls it is advisable that you check that the proportion of border features to the overall area is acceptable before placing your order as some border combinations are very wide and may appear out of place on a small or narrow floor.
All orders placed on our website are normally available from stock unless otherwise indicated, but are subject to stock availability at the time of placement. Once we have checked stocks for quantity and shade we will confirm your order by email to the address provided by return or within two working days at the latest.
You will be notified of any out of stock items and an approximate delivery date. Please note that these are guidelines only and may not be relied upon as being specific. We will not be liable for any expense incurred by you for trades people’s lost time in the event of any delays.
We will always try to update the website to warn you of items that are out of stock or where there are known supply issues.
If we cannot supply your order within the time frame that you require, you will be entitled to cancel your order for full refund.
No order submitted by you, the buyer, shall be deemed to be accepted by us unless and until we confirm acceptance of your order in writing or by telephone (whichever is applicable).
Only when you order is complete and despatched will an invoice be raised and a Contract of Sale be made between us.
Price
The price of the goods will be the price quoted in Pounds Sterling on our website at the date the order is received and will include VAT. Delivery charges may be applicable depending on the value of order and place of delivery. Please refer to the section of our website for details.
Goods and Warranty
All images, descriptive matter and specifications are for the sole purpose giving an approximate description of the goods and is intended as a guide only.
All samples given are used as an example of colour and finish only.
We advise you to purchase sufficient goods from the same range and/or batch as tiles may be sourced from different locations at different times which may result in variation in size and/or colour.
Shading and calibration of size are inherent in ceramic tiles as in any other manufactured products made in batch. All our tiles from European source comply with European standards of manufacture and are first choice quality unless otherwise stated.
Care must be taken to check that all shades and sizes are compatible. It is common for there to be a slight difference in calibration when using two or more different tiles, borders or features. We will do our best to minimalise this eventuality where we can.
Before fixing please check that batch and calibre numbers on the boxes of each item are the same and that you are happy with size calibre and shades and that the tiles are as you ordered before fixing. No claim will be accepted once tiles have been fixed in part or in full. If you are not the fixer, then please ensure that your fixer checks before fixing. Also remember that many tiles are deliberately shaded in the box to correctly mimic a natural effect as in stone, marble, wood etc.
Any liability for defect is with the manufacturer. Simply Tiles will not be held liable but will take all steps to ensure that the manufacturer fulfils its responsibility. We will endeavour, at our discretion, to replace any defective items free of charge or refund any past order that is proven to be defective. No further liability for loss or other expense will be accepted by Simply Tiles Ltd.
Any claims for defective goods or those proved to be not fit for purpose (where purpose is stated at time of ordering), or any refusal of delivery for this or any other reason must be submitted in writing (with pictures where appropriate) within 3 working days of delivery or collection.
Returns
Returns will only be accepted strictly on production of the original invoice and subject to our normal policy. We remind all customers that special order tiles, surplus to requirement, cannot be returned. Stock lines may only be returned within 28 days from invoice date and where we still have stocks of the same batch. Returns may incur a restocking charge.
